In Thor The Dark World the bad guy is called Malekith and he is the king of the dark elves! 

Is this from the Thor comics or is it a very old story that anyone can use?

I wanna know who got ripped off?

Apparently Malekith made his first Marvel appearance in 1984, and found his way into the dark elf book in 1995.

GW's known to "borrow" or use names from known sources to describe named characters (my favorite being Luthor Huss, based of Martin Luther and Johann Huss, who both fit into the character of Luthor Huss; or, rather, Luthor Huss bases his character and fluff off of similarities to Martin and Johann :P).

So, this is no surprise. But still, an awesome catch! ;)
